Coverage Analysis

In a case of personal injury, premises liability, professional malpractice, or other instance where an insurance policy may be involved, a preliminary question that must often be addressed is whether a valid policy is in force that applies to the particular claim in question. Our firm performs an in-depth coverage analysis and provides an opinion letter which the client can utilize in determining how to proceed, such as whether to settle, litigate, or deny a claim. In addition to coverage (payment of benefits) issues, we analyze whether an insurance company's duty to defend against a third party claim is triggered, and also assess an insurer's potential exposure to bad faith claims.

Coverage Litigation

Sometimes this threshold issue of whether coverage exists must be litigated. We litigate the issue in declaratory judgment proceedings or litigate the underlying matter under a reservation of rights, where appropriate. While the insured may only need to prove that a potential for coverage exists in order to prevail, a declaratory judgment is nevertheless a complex matter requiring the knowledge and expertise of experienced insurance coverage trial counsel.
